Warranty Deed

A Warranty Deed transfers real property with a guarantee that the seller has the right to sell the land, that the land has no hidden encumbrances, and that the seller will resolve any problems with the Deed that arise. An “encumbrance” is something that could interfere with the buyer’s enjoying full use of the land, such as liens, unpaid taxes, or a third party’s legal right to use the land (known as an “easement”).
